Bernhardt v. NC State Highway Patrol
A recent case litigated by D. Hardison Wood has resulted in a decision in favor of our client against the NC State Highway Patrol. Dick Bernhardt drove his sick wife to the hospital in June, 2007, speeding and running several red lights on his way. Trooper Matthew Cape approached him upon arrival to the hospital and forcefully arrested him, as you can see in the video from this ABC 11 article.
Mr. Bernhardt brought a civil lawsuit against the Highway Patrol for excessive force after his elbow was dislocated by officer Cape. In the end, the state’s Industrial Commission found in favor of Mr. Bernhardt, awarding him $16,000 in combined damages and attorney fees. Bernhardt hopes that the ruling will reduce the amount of force officers use in the future.
